Collection: General conditions of the Brincatoys Cash Back Program
The Customer Loyalty Program, hereinafter referred to as "Brincatoys Cash Back Program"is promoted and organized by Brincadeiras ao Cubo, Comércio de Jogos e Brinquedos, Lda., with registered office at Marina Plaza, Edifício Daytona Beach, Bloco 27-A, Loja 79, Vilamoura, 8125-401 Quarteira, Tax ID no.: 510204538, and is subject to the General Conditions, which define the operating conditions of the "Brincatoys Cashback Program", which constitute this document, hereinafter referred to as the "Brincatoys Cashback Program General Conditions".
O "Brincatoys Cash Back Program" is intended exclusively for customers who meet the requirements set out in the General Conditions and who join the program in accordance with what is stipulated in this program (hereinafter referred to as the "Member").
Adherence to the "Brincatoys Cash Back Program" implies full and unreserved acceptance by the Adherent of these General Conditions, binding Brincadeiras ao Cubo, Lda. under the terms of these general conditions.
Failure by Brincadeiras ao Cubo, Lda. Lda.'s failure to apply any of these General Conditions shall not result in the waiver of the right to demand compliance with any of these conditions.
The application of the "Brincatoys Cash Back Program" is limited to the online store at Brincatoys (hereinafter, the "Website").
The Brincatoys Cash Back Program allows the Member/customer to accumulate 4% of the amount spent on the purchase of products and provides benefits.
I. JOINING THE BRINCATOYS CASHBACK PROGRAM
a) Membership of the Brincatoys Cash Back Program will be effected by the member registering as a customer in our online store, located at www.brincatoys.pt, brincatoys.com or brincatoys.es, which will entitle the customer to become a participant in the program, in accordance with the provisions of these General Conditions.
b) Brincatoys will process the customer data requested in the registration request in accordance with the provisions of Law 58/2019 of August 8 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016) and any implementing regulations that are or come into force, stipulated in these General Conditions.
c) In any case, the correct and complete communication of the data identified as mandatory in the "Customer Registration" is an essential requirement for the registered/adhering customer to have the right to participate in the Brincatoys Cashback program, so its non-entry or incorrect, illegible or incomplete entry will result in the Registered Customer not participating in said program.
d) Members are responsible for keeping their personal data up to date at www.brincatoys.pt, brincatoys.com or brincatoys.es.. Brincatoys shall not be held liable in cases where the Member does not receive its offers and/or communications due to incorrect or obsolete data.
II. BRINCATOYS CASHBACK PROGRAM
a) The Brincatoys Cash Back Program is based on the accumulation and redemption of balance/credit generated through purchases made by customers on our website (brincatoys.co.uk; brincatoys.com or brincatoys.es.
b) The amount of credit earned will be accumulated in the Member's account or profile on the Website, with the aim of benefiting from purchases of products available on www.brincatoys.pt, brincatoys.com or brincatoys.es.
c) Brincatoys reserves the right to verify the identity of the Member for any circumstance related to the Brincatoys Cash Back Program (i.e. making purchases, returning, accumulating and redeeming points, enjoying associated benefits, etc.).
III. OBTAINING CASHBACK
Once registered in the Brincatoys Cashback Program, each member can accumulate cashback credit as follows:

For every €1 of product purchases you make in our online store, you will receive 4% of your purchase excluding postage. Each euro spent equals €0.04 credit (4% of your purchase excluding postage). For example: if you buy a product worth €13.99 you will receive €0.52 in credit (€13 x 4% = €0.52).
The value of the cashback credit cannot be assigned or exchanged for cash or its value in kind, nor can it be transferred to third parties.
IV. ADVANTAGES OF THE BRINCATOYS CASHBACK PROGRAM
With the Brincatoys Cash Back Program, all your purchases will be rewarded. This program allows registered customers to accumulate value in euros/cents with those purchases which will give you access to the following advantages:
a) For every €1 spent on product purchases you make in the online store, you will accumulate 4% of your purchase in credit. The refund is calculated excluding taxes and shipping costs (if any).
b) The value of the cashback credit from your last purchase in the online store will be made available in the account associated with the registered customer once the order payment process has been completed.
c) During the year, we offer discounts linked to different promotions.
d) Cashback credit will be accrued in whole numbers, rounded down (example: an order worth €10.99 will be credited with €0.40 in cashback credit).
h) If you use the cashback credit redemption/discount on a purchase, the number of cashback credits awarded for that purchase will take into account the value resulting from the difference between the total of the order, excluding shipping, and the value of the redemption/discount made.
V. REDEMPTION OF ACCUMULATED CASHBACK CREDIT
a) Brincatoys Cashback Program credits earned by customers will be accumulated in the Registered Customer's balance after the customer has paid for the purchase and may only be redeemed/used by registered customers for future purchases at brincatoys.co.uk ;www.brincatoys.com; or www.brincatoys.es.
b) You can use your credits in the online store, once they have been credited to your account, to purchase products of any value, but the value of the product to be purchased must be greater than the value of the credits redeemed/used to make the purchase.
c) The discount resulting from the redemption/use of credits is made on the total value of the products purchased through the order and does not cover shipping costs.
d) Credits can be accumulated with other direct discount promotions.
e) The redemption of credits will be made in whole numbers and with a minimum of €1.00by conversion to be used in the store's shopping cart.
f) You can use your credits in the online store, after they have been credited to your account, to purchase products of any value, but the value of the product to be purchased must be greater than the value of the credits redeemed/used to make the purchase.
g) When this happens, the redeemed/used credits will be deleted from the existing balance in the registered customer's account.
h) In situations where the customer has redeemed the credits, if they do not make the payment within the deadline, the purchase will be canceled and the credit will be credited to the customer's account balance.
i) Points cannot be awarded or exchanged for cash or their value in kind.
VI. VALIDITY OF THE CASHBACK BALANCE CANCELLATION OF THE LOYALTY PROGRAM
a) Credits obtained through purchases made by the registered customer will be valid for three hundred and sixty-five (365) days from the date of purchase of the first order in which the credits were generated, and will be renewed whenever the customer makes a new purchase or redeems credits.
b) The registered customer will be notified of the expiry of the credits by e-mail thirty (30) days before the expiry date.
c) If the customer decides to cancel their registration as a customer, all they have to do is send an e-mail to geral@brincatoys.ptrequesting that their registration be canceled. This cancellation process can take up to 72 hours.
d) Once the cancellation has taken place, the credits accumulated with the Brincatoys Cashback Program to date will disappear and cannot be recovered.
VII. RETURN OF PRODUCTS
a) In the event of products being returned, the amount of the cashback credit will be deducted or refunded, as the case may be, in accordance with the following:
- (i) Full refund: If a Member returns all the products purchased in a purchase, the full amount of cashback credit that was accumulated or redeemed on said purchase will be deducted.
(ii) Partial refund: In the event that a Member returns part of the products purchased in a purchase, the amount of cashback credit that was accumulated or redeemed on that purchase, if any, will be deducted on a pro-rata basis, based on the price of the product being returned.
b) Deductions of the cashback amount will be made within 72 hours of confirmation of the refund. Therefore, 72 hours after confirmation of the refund, the Member's balance must be updated with the balance of the cashback credit held by the Member.
VIII. CONSULTATION OF POINTS AND COMMUNICATIONS
a) The Member can consult the cashback credit balance available at www.brincatoys.pt, brincatoys.com or brincatoys.es, in the customer area.
b) Brincatoys will send its electronic communications related to the Cash Back Program by e-mail to the e-mail address provided by the member at the time of joining the Brincatoys Cash Back Program.
IX. PROCESSING OF PERSONAL DATA

X. MODIFICATION AND CANCELLATION OF THE GENERAL CONDITIONS
a) Brincatoys reserves the right to unilaterally modify the General Conditions. Notwithstanding the foregoing, the latest version of the General Conditions applicable to the Brincatoys Cash Back Program will be available at brincatoys.co.uk, brincatoys.com and brincatoys.es.
b) Brincatoys also reserves the right to modify, suspend or cancel the Cash Back program, in which case members will be informed via the website. brincatoys.pt, brincatoys.com and brincatoys.es.
c) In the event of cancellation of the Brincatoys Points Program, Members will have a maximum period of 30 days to redeem the points accumulated to date, otherwise these points will be forfeited.
c) In the event of cancellation of the Brincatoys Cashback Program, Members will have a maximum period of 30 days to redeem the cashback balance accumulated to date, otherwise this cashback balance will be lost.
d) In the event of force majeure, the Brincatoys Cash Back Program may be suspended or cancelled without prior notice to Members.
XI. LIABILITY
a) Modification or cancellation of the Cash Back Program by Brincatoys shall not entitle the Member to any compensation whatsoever.
b) Participation in the Brincatoys Cash Back Program requires compliance with the General Conditions. Consequently, Brincatoys reserves the right to cancel the associated advantages or benefits if a Registered Customer carries out any conduct that implies a breach of these General Conditions. In any case, Brincatoys will terminate the Member's Cash Back Program without prior notice and by the most convenient means, without the Registered Customer being entitled to any compensation, in the following cases:
(i) in the event of fraud or attempted fraud in the store by the Registered Customer;
(ii) in the event of improper use of the Cash Back Program;
(iii) in the event of actions intended to alter the proper functioning of the Cash Back Program.
c) Brincatoys shall not be liable for the consequences caused by the lack of communication with the Registered Customer when such lack of communication is due to a malfunction of the e-mail address or the inaccuracy of the information provided by the customer.
d) Brincatoys cannot guarantee the availability and continuous operation of the Cash Back Program, in particular when there is a technical malfunction of the computer systems, servers, computer equipment, malfunction of the Internet, destruction of data by hacking or error, or any other technical problem.
e) Whenever reasonably possible, Brincatoys will notify the Registered Customer of any interruptions in the operation of the Cash Back Program. In this regard, Brincatoys assumes no liability for damages of any kind that may arise due to the lack of availability or continuity of the operation of the Cash Back Program.
XII. Jurisdiction and Applicable Law.
a) The use of our website and consumer disputes related to the Cash Back Program will be governed by Portuguese law, and the customer may resort to a territorially competent dispute resolution entity considering that transactions carried out through it are considered to have been concluded in the area where the seller has its registered office.
b) The resolution of any type of controversy, dispute or discrepancy that may arise between the Customer and the seller, from the interpretation, application and execution of these general conditions will be submitted to the Faro District Court, with express waiver of any other.
c) Without prejudice to the rights arising from Portuguese law, in the course of their commercial relations, the parties undertake to try to find solutions to any conflict that arises in a spirit of good faith and cooperation.
XIII. ENTRY INTO FORCE
These General Conditions come into force on January 1, 2024.
