General Terms and Conditions of the Brincatoys Points Program

The Customer Loyalty Program, hereinafter referred to as the "Brincatoys Points Program", is promoted and organized by Brincadeiras ao Cubo, Comércio de Jogos e Brinquedos, Lda., with headquarters at Marina Plaza, Edifício Daytona Beach, Bloco 27-A, Loja 79, Vilamoura, 8125-401 Quarteira, Tax Identification Number: 510204538, and is subject to the General Conditions, which define the operating conditions of the "Brincatoys Points Program", which constitute this document, hereinafter referred to as the "General Conditions of the Points Program".

The "Brincatoys Points Program" is intended exclusively for customers who meet the requirements set forth in the General Terms and Conditions and who adhere to it in accordance with the provisions of this program (hereinafter referred to as "Registered Customer").

The adhesion to the "Brincatoys Points Program" implies the full and unreserved acceptance, by the registered customer, of these General Terms and Conditions, binding Brincadeiras ao Cubo, Lda. under the terms of these general conditions.

The non-application by Brincadeiras ao Cubo, Lda. of any of these General Terms and Conditions does not entail the waiver of the right to demand compliance with any of these conditions.

The application of the "Brincatoys Points Program" is limited to the online store at Brincatoys.pt (hereinafter, "Website").

The Brincatoys Points program allows you to accumulate points (1 euro spent = 4 points), based on the purchases of the registered customer and provides the opportunity to obtain advantages.

I. JOINING THE BRINCATOYS POINTS PROGRAM

The adhesion to the Brincatoys Points Program by the registered customer will be carried out through registration on our online store, located at www.brincatoys.pt, brincatoys.com or brincatoys.es, which will grant the customer the right to become a participant in it, in accordance with the provisions of these General Conditions.

Brincatoys will process the customer data requested in the membership application, in accordance with the provisions of Law 58/2019 of August 8 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data, General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016) and any implementing regulations that are or enter into force, stipulated in these General Terms and Conditions.

In any case, the correct and complete communication of the data identified as mandatory in the "Customer Registration" is an essential requirement for the registered customer to be entitled to participate in the Brincatoys points program, so that failure to enter or incorrect, illegible or incomplete entry will result in non-participation by the Registered Customer in said program.

The Registered Customer is responsible for keeping their personal data updated at www.brincatoys.pt, brincatoys.com and brincatoys.es. Brincatoys is not responsible in cases where the Registered Customer does not receive their offers and/or communications due to incorrect or outdated data.

II. BRINCATOYS POINTS PROGRAM

The Brincatoys Points Program is based on the accumulation and redemption of points generated through purchases made by registered customers on our website (Brincatoys; brincatoys.com or brincatoys.es.

b) Points will be accumulated in the customer's account or profile on the Website, in order to enjoy benefits when purchasing products available atBrincatoys; brincatoys.com and brincatoys.es.

Brincatoys reserves the right to verify the customer's identity for any circumstance related to the Brincatoys Points Program (i.e., making purchases, returning, accumulating and redeeming points, enjoying associated benefits, etc.).

III. POINTS ACQUISITION

Once registered in our online store, the customer benefits from the Brincatoys Points Program, in which they can accumulate points as follows:

Points cannot be awarded or exchanged for cash or their cash value.

IV. ADVANTAGES OF THE BRINCATOYS POINTS PROGRAM

With the Brincatoys Points Program, all your purchases will be rewarded. This program allows customers to accumulate points with these purchases that will give you access to the following advantages:

For every €1 of product purchases you make in the online store, you will receive4 points.Each accumulated point is worth €0.01 (4% of your purchase excluding shipping costs).

If you share the website link on your Facebook, you will be automatically attributed once,50 pointsto use on your next purchases.

On your birthday, if the date is included in the registration data provided or is provided up to 60 days before the birthday, you will be automatically assigned,300 pointsto be used/redeemed during the birthday month, expiring after that date if not redeemed or used.

By subscribing to the newsletter, you will be automatically assigned100 pointsto use on your next purchases.

eIn situations where a third party makes a purchase in our online store using the referral couponsent by the proposing registered customer,for every third guestyou will be assigned automatically,150 pointsto use on your next purchases.


The third reward must be redeemed using the coupon presented in the discount invitation link, generated in the field "Invite friends and get a discountThe proposal is sent by the proponent to the third party.

If you follow us on Instagram, you will be automatically awarded 25 points once.pointsto use on your next purchases.

If you follow us on YouTube, you will be automatically awarded 25 points once.pointsto use on your next purchases.

During the year, we offer discounts linked to different promotions.

The accumulation of points will be done in whole numbers, rounded down (example: for an order worth €10.99, 40 points will be awarded).

In case of using the points redemption/discount on a purchase, the number of points awarded for that purchase will take into account the value resulting from the difference between the total order amount, excluding shipping costs, and the value of the redemption/discount made.

REDEMPTION OF ACCUMULATED POINTS

The Brincatoys Points Program points earned by registered customers will be accumulated in the Registered Customer's balance after the customer receives the purchase and can be redeemed/used for future purchases atBrincatoyswww.brincatoys.com; or www.brincatoys.es.

You can use your points in the online store, after they are credited to your account, in a purchase of products of any value, however, the value of the product to be purchased must be higher than the value of the points redeemed/used in the purchase.

The discount resulting from the redemption/use of points is applied to the total value of the products purchased through the order and does not cover shipping costs (Shipping).

Points can be accumulated with other direct discount promotions.

The points redemption will be done in whole numbers, through the conversion of points into a discount coupon to be used at the store's checkout.

You can use your points in the online store, after they are credited to your account, to purchase products of any value, however, the value of the product to be purchased must be higher than the value of the points redeemed/used in the purchase.

When this happens, the redeemed/used points will be deducted from the existing points balance in the registered customer's account.

The registered customer can share their points balance with a third party by converting the points into a discount voucher.

Points cannot be awarded or exchanged for cash or their cash value.

EN VI. VALIDITY OF POINTS, VOUCHER AND CANCELLATION OF THE LOYALTY PROGRAM

Points obtained through purchases made by the registered customer will be valid for three hundred and sixty-five (365) days from the date of acquisition of the first order in which the points were generated, renewing this date whenever the customer makes a new purchase or redeems points.

The registered customer will be notified of the expiration of points by email thirty (30) days in advance of the expiration date.

In case the customer decides to cancel their registration as a customer, they just need to send an email togeneral@brincatoys.ptRequesting the cancellation of your registration. This cancellation process may take up to 72 hours.

Once the cancellation is effective, the points accumulated with the Brincatoys Points Program, up to that date, will disappear and cannot be recovered.

RETURN OF PRODUCTS

In case of product returns, points will be deducted or refunded, as appropriate, according to the following:

(i) Full refund: if a Registered Customer returns all products purchased in a transaction, all points accumulated or redeemed in said transaction will be deducted.

Partial refund: in the event that a Registered Customer returns part of the products purchased in a transaction, the points accumulated or redeemed in that transaction, if any, will be deducted on a proportional basis, based on the price of the product being returned.

b) Point deductions will be made within 72 hours after the refund confirmation. Therefore, up to 72 hours after the refund confirmation, the balance of the Registered Customer should be updated with the points held by the Adherent.

VIII. POINTS AND COMMUNICATIONS CONSULTATION

The Registered Customer can check the available points atBrincatoysBrincatoys.com or Brincatoys.es, according to your customer area.

Brincatoys will send all its electronic communications related to the Points Program, by email, to the email address provided by the customer and included in their customer registration.

X. PERSONAL DATA PROCESSING

Information about the processing of customers' personal data can be found atPrivacy Policy.

X. MODIFICATION AND CANCELLATION OF THE GENERAL CONDITIONS

a) Brincatoys reserves the right to unilaterally modify the General Terms and Conditions. Notwithstanding the foregoing, the latest version of the General Terms and Conditions applicable to the Brincatoys Points program will be available atBrincatoysBrincatoys.com and Brincatoys.es.

Brincatoys also reserves the right to modify, suspend or cancel the Points program, in which case the members will be informed through the websiteBrincatoysBrincatoys.com and Brincatoys.es.

In case of cancellation of the Brincatoys Points Program, Members will have a maximum period of 30 days to redeem the points accumulated up to that date, otherwise, these points will be lost.

In case of force majeure, the Brincatoys Points Program may be suspended or canceled without prior notice to Participants.

Responsibility

The modification or cancellation of the Points Program by Brincatoys will not entitle the Participant to any type of compensation.

b) Participation in the Brincatoys Points Program requires compliance with the General Terms and Conditions. Consequently, Brincatoys reserves the right to cancel the associated advantages or benefits, in the event that a Registered Customer engages in any conduct that violates these General Terms and Conditions. In any case, Brincatoys will terminate the Participant's Points Program without prior notice and by the most convenient means, without the registered customer being entitled to any compensation, in the following cases:

(i) in case of fraud or attempted fraud in the store by the Registered Customer;

(ii) in case of misuse of the Points Program;

(iii) in case of actions aimed at altering the proper functioning of the Points Program.

Brincatoys will not be responsible for the consequences caused by the lack of communication with the Registered Customer when such lack of communication is due to a malfunction of the email address or the inaccuracy of the information provided by the customer.

Brincatoys cannot guarantee the availability and continuous operation of the Points Program, particularly when there is a technical malfunction of computer systems, servers, computer equipment, Internet malfunction, data destruction by hacking or error, or any other technical problem.

Whenever reasonably possible, Brincatoys will notify the Registered Customer of any disruptions in the operation of the Points Program. In this regard, Brincatoys does not assume any responsibility for damages of any kind that may arise due to the lack of availability or continuity of the operation of the Points Program.

Jurisdiction and Applicable Law.

The use of our website and consumer disputes related to the Points Program will be governed by Portuguese law, and the customer may resort to a territorially competent dispute resolution entity considering that transactions made through it are considered concluded in the seller's headquarters area.

The resolution of any kind of controversy, dispute or discrepancy that may arise between the Customer and the seller, regarding the interpretation, application and execution of these general conditions, shall be submitted to the court of the District of Faro, with express waiver of any other.

However, without prejudice to the rights arising from Portuguese Law, in the course of their commercial relations, the parties undertake to try to find solutions to any conflict that may arise in a spirit of good faith and cooperation.

XIII. ENTRY INTO FORCE

These General Conditions will come into effect on January 1, 2024.
